Due to the heavy workload at the IND, they have introduced a flexible rule which will be extended until January 22, 2023. This additional rule allows the  highly skilled migrant to start working despite the absence of the residence document or residence endorsement sticker. This IND exception rule applies to highly skilled migrants who:

  • Received a notification letter with the positive decision and is allowed to work
  • Received a notification letter with the positive decision and is allowed to keep working based on the extension application
  • Have applied for the first residence permit without a provisional residence permit (MVV)

In the above cases, the highly skilled migrant is allowed work without a residence document for up to 4 months.

Please note that this rule is not valid for the European Blue Card, Scientific Researcher, and Intra Corporate Transferee (ICT). This is because these highly skilled workers do need a residence endorsement sticker to start working. This sticker is needed if the extension application has not yet been decided. Of course, this extension application is related to the same employer (recognized sponsor).
