Are you applying for extension of a highly skilled migrant residence permit? Then the highly skilled migrant’s salary must meet the most recent wage criterion on the effective date of the extension. The wage criterion for highly skilled migrants is indexed annually on 1 January. This is announced at the end of each year through a change in the Foreign Nationals (Employment) (Implementation) Decree (BuWav) and publication in the Government Gazette. Is the indexed wage criterion still unknown when you want to apply for extension? Then wait for publication first, if possible. Does your highly skilled migrant’s residence permit expire in January, for example? Then do not yet apply for extension in November if you do not know what the new wage criterion will be.
